1. Agreement to Terms

Welcome to Sudoku Mind Booster ("the App," "we," "us," or "our"). These Terms of Service ("Terms") govern your access to and use of the Sudoku Mind Booster mobile application.

By downloading, installing, or using the App, you agree to be bound by these Terms. If you do not agree to these Terms, do not use the App.

2. Acceptance of Terms

By using Sudoku Mind Booster, you represent and warrant that:

• You are at least 13 years of age (or the minimum age required in your jurisdiction)
• If you are under 18, you have obtained parental or guardian consent
• You have the legal capacity to enter into these Terms
• You will comply with all applicable laws and regulations
• You will use the App only for lawful purposes

3. License to Use

3.1 Grant of License

Subject to your compliance with these Terms, we grant you a limited, non-exclusive, non-transferable, revocable license to:

• Download and install the App on devices you own or control
• Use the App for your personal, non-commercial use
• Access and use the features and services provided by the App

3.2 License Restrictions

You agree NOT to:

• Copy, modify, or create derivative works of the App
• Reverse engineer, decompile, or disassemble the App
• Remove, alter, or obscure any proprietary notices
• Use the App for any commercial purpose without our permission
• Rent, lease, lend, sell, or redistribute the App
• Use the App in any way that violates applicable laws
• Attempt to gain unauthorized access to the App or its systems
• Use automated systems or software to extract data from the App

4. Subscriptions and Payments

4.1 Subscription Plans

Sudoku Mind Booster offers the following subscription options:

• Weekly Premium: $0.99 for 7 days (non-renewable)
• Monthly Premium: $2.99 per month (auto-renewable)
• Yearly Premium: $24.99 per year (auto-renewable)

4.2 Payment Processing

All payments are processed through Apple's App Store. By purchasing a subscription, you agree to Apple's Terms of Service and payment terms.

4.3 Auto-Renewal

Monthly and Yearly subscriptions automatically renew unless you cancel at least 24 hours before the end of the current period. Your Apple ID account will be charged for renewal within 24 hours prior to the end of the current period.

4.4 Free Trial (if applicable)

If we offer a free trial, you may cancel at any time during the trial period without charge. If you do not cancel before the trial ends, you will be automatically charged for the subscription.

4.5 Managing Subscriptions

You can manage and cancel subscriptions through your Apple ID settings:

1. Open iPhone Settings
2. Tap your name at the top
3. Tap "Subscriptions"
4. Select "Sudoku Mind Booster"
5. Manage or cancel your subscription

4.6 Refunds

All purchases are final and non-refundable except as required by law. Refund requests must be made through Apple's App Store, as we do not process payments directly.

To request a refund from Apple:

1. Visit reportaproblem.apple.com
2. Sign in with your Apple ID
3. Find your Sudoku Mind Booster purchase
4. Select "Report a Problem" and follow the prompts

4.7 Price Changes

We reserve the right to change subscription prices at any time. Price changes will not affect existing subscriptions until renewal. You will be notified of price changes in advance.

5. Premium Features

Premium subscribers receive:

• Unlimited Hints: Access to unlimited puzzle hints
• Ad-Free Experience: No advertisements displayed
• Premium Logo: Special badge indicating premium status

We reserve the right to modify, add, or remove premium features at any time with reasonable notice to subscribers.

6. Free Version

6.1 Hint System

Free users receive:

• 3 free hints
• Ability to earn additional hints by watching advertisements (+2 hints per ad)

6.2 Advertisements

The free version displays advertisements provided by Google AdMob. By using the free version, you consent to viewing ads. Premium subscribers do not see advertisements.

7. User Conduct

You agree to use the App responsibly and in accordance with these Terms. You will NOT:

• Use the App for any illegal or unauthorized purpose
• Violate any laws in your jurisdiction
• Infringe on intellectual property rights
• Attempt to hack, exploit, or damage the App
• Use the App to transmit viruses or malicious code
• Interfere with other users' enjoyment of the App
• Impersonate any person or entity
• Collect or harvest information from the App

8. Intellectual Property Rights

8.1 Ownership

The App and all its content, features, and functionality (including but not limited to software, code, design, graphics, logos, and user interface) are owned by Revanton and are protected by international copyright, trademark, patent, trade secret, and other intellectual property laws.

8.2 Trademarks

"Sudoku Mind Booster" and related logos are trademarks of Revanton. You may not use these trademarks without our prior written permission.

8.3 User Content

You retain ownership of any content you create using the App (such as game statistics and saved games). However, this content is stored locally on your device and we do not claim any rights to it.

9. Privacy

Your privacy is important to us. Our collection and use of personal information is governed by our Privacy Policy, which is incorporated into these Terms by reference.

Key privacy points:

• We do not collect personal information
• All game data is stored locally on your device
• iCloud sync is optional and uses your private iCloud storage
• Free users may see ads from Google AdMob

10. iCloud Sync

If you enable iCloud sync (optional):

• Your game data and settings will be stored in your private iCloud account
• Data will sync across all devices signed into the same iCloud account
• You are responsible for maintaining your iCloud account security
• We are not responsible for data loss due to iCloud issues
• You can disable iCloud sync at any time in Settings

iCloud sync is subject to Apple's iCloud Terms and Conditions.

11. Disclaimers and Warranties

11.1 No Warranties

TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE DISCLAIM ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO:

• Warranties of merchantability
• Fitness for a particular purpose
• Non-infringement
• Accuracy, reliability, or completeness of content
• Uninterrupted or error-free operation
• Security or virus-free operation

11.2 Use at Your Own Risk

You acknowledge that:

• You use the App at your own risk
• We do not guarantee the App will meet your requirements
• The App may contain bugs or errors
• We may modify or discontinue the App at any time
• You are responsible for backing up your data

12. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW:

12.1 No Liability for Damages

WE SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO:

• Loss of profits or revenue
• Loss of data or information
• Loss of business opportunity
• Personal injury or property damage
• Emotional distress

12.2 Maximum Liability

OUR TOTAL LIABILITY TO YOU FOR ANY CLAIMS ARISING FROM YOUR USE OF THE APP SHALL NOT EXCEED THE AMOUNT YOU PAID US IN THE 12 MONTHS PRECEDING THE CLAIM, OR $25, WHICHEVER IS LESS.

12.3 Basis of the Bargain

You acknowledge that we have set our prices and entered into these Terms in reliance upon the disclaimers and limitations of liability set forth herein.

13. Indemnification

You agree to indemnify, defend, and hold harmless Revanton, its officers, directors, employees, agents, and affiliates from and against any claims, liabilities, damages, losses, costs, or expenses (including reasonable attorneys' fees) arising out of or relating to:

• Your use or misuse of the App
• Your violation of these Terms
• Your violation of any rights of another party
• Your violation of any applicable laws or regulations

14. Termination

14.1 Termination by You

You may stop using the App at any time by:

• Deleting the App from your device
• Canceling your subscription (if applicable)

14.2 Termination by Us

We reserve the right to suspend or terminate your access to the App at any time, with or without notice, for:

• Violation of these Terms
• Fraudulent or illegal activity
• Abuse of the App or its features
• Any other reason at our sole discretion

14.3 Effect of Termination

Upon termination:

• Your license to use the App immediately ends
• You must delete the App from all devices
• Subscription fees are non-refundable (except as required by law)
• Provisions that should survive termination will continue to apply

15. Changes to Terms

We reserve the right to modify these Terms at any time. When we make changes, we will:

• Update the "Last Updated" date at the top of this page
• Notify you through the App or via email (if we have your email)
• Provide reasonable notice for material changes

Your continued use of the App after changes are posted constitutes your acceptance of the modified Terms. If you do not agree to the modified Terms, you must stop using the App.

16. Changes to the App

We reserve the right to:

• Modify, update, or discontinue the App or any features at any time
• Change subscription prices (with advance notice to existing subscribers)
• Add or remove features from free or premium versions
• Perform maintenance that may temporarily interrupt service

We are not liable for any modifications, suspensions, or discontinuations of the App.

17. Third-Party Services

17.1 Apple App Store

The App is distributed through Apple's App Store. Your use of the App is also subject to Apple's Terms of Service and App Store Terms and Conditions.

17.2 Google AdMob

Free users may see advertisements from Google AdMob. Your interaction with ads is subject to Google's Terms of Service and Privacy Policy.

17.3 Third-Party Links

The App may contain links to third-party websites or services. We are not responsible for the content, privacy practices, or terms of third-party sites.

18. Dispute Resolution

18.1 Informal Resolution

If you have a dispute with us, please contact us first at support@sudokumindbooster.com. We will attempt to resolve the dispute informally.

18.2 Arbitration Agreement

If we cannot resolve the dispute informally, you agree that any disputes arising out of or relating to these Terms or the App shall be resolved through binding arbitration, except that:

• You may bring claims in small claims court if they qualify
• Either party may seek injunctive relief in court

18.3 Class Action Waiver

YOU AGREE THAT DISPUTES WILL BE RESOLVED ON AN INDIVIDUAL BASIS ONLY. YOU WAIVE ANY RIGHT TO PARTICIPATE IN A CLASS ACTION LAWSUIT OR CLASS-WIDE ARBITRATION.

18.4 Governing Law

These Terms shall be governed by and construed in accordance with the laws of Singapore, without regard to its conflict of law provisions.

19. Apple-Specific Terms

If you access the App through an Apple device, the following additional terms apply:

19.1 Acknowledgment

You acknowledge that:

• These Terms are between you and Revanton, not Apple
• Apple has no obligation to provide maintenance or support
• Apple is not responsible for the App or its content
• Apple is not responsible for addressing any claims relating to the App

19.2 Third-Party Beneficiary

Apple and its subsidiaries are third-party beneficiaries of these Terms. Upon your acceptance of these Terms, Apple will have the right to enforce these Terms against you.

19.3 Product Claims

In the event of any failure of the App to conform to any applicable warranty, you may notify Apple, and Apple will refund the purchase price (if any). To the maximum extent permitted by law, Apple will have no other warranty obligation with respect to the App.

20. General Provisions

20.1 Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and us regarding the App.

20.2 Severability

If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions will remain in full force and effect.

20.3 Waiver

Our failure to enforce any right or provision of these Terms will not be considered a waiver of those rights.

20.4 Assignment

You may not assign or transfer these Terms or your rights under these Terms without our prior written consent. We may assign these Terms without restriction.

20.5 Force Majeure

We are not liable for any failure or delay in performance due to circumstances beyond our reasonable control, including acts of God, war, terrorism, riots, embargoes, acts of civil or military authorities, fire, floods, accidents, pandemics, strikes, or shortages of transportation, facilities, fuel, energy, labor, or materials.

20.6 Survival

Provisions that by their nature should survive termination shall survive, including but not limited to: ownership provisions, warranty disclaimers, indemnity, and limitations of liability.
